What is the Timeframe to Apply Directly for Forgiveness of Your PPP Loan?

Borrowers can apply for forgiveness any time up to the maturity date of the loan. However, the deferment on PPP loans has ended and loan payments have begun if forgiveness applications have not yet been received. The SBA has streamlined the forgiveness process for PPP Borrowers with an original loan amount $150,000 or less, to apply through the SBA PPP Direct Forgiveness Portal. Eligible borrowers should follow these steps as soon as possible:

  1. Register on the SBA PPP Direct Forgiveness Portal and verify your information.
  2. Complete the application and electronically sign, which will notify Lendistry the application has been submitted.
  3. Monitor emails and respond promptly to any requests from Lendistry and/or the SBA.
  4. The SBA will review and inform you when a decision has been made or more information is needed on your PPP loan forgiveness application.

If you submitted your application for forgiveness on the SBA direct website, monitor your email inbox as the SBA may: 1) Notify you of any outstanding action items, which you will want to address as soon as possible. 2) Notify you that a decision has been made on your PPP loan forgiveness request. After the forgiveness decision has been made by the SBA, Lendistry may contact you with next steps.

Is your PPP Loan in Repayment?

If you received partial forgiveness, were denied forgiveness, or choose not to submit an application for forgiveness, your PPP loan will go into repayment over the remaining term of your loan. Lendistry will debit payments via Automated Clearing House (ACH) on the due date. If you are new to Lendistry, monitor your email inbox for a request via DocuSign to complete the necessary ACH Authorization so your payment can be debited by Lendistry.

What is the criteria for PPP loan forgiveness?

PPP loan borrowers may be eligible for loan forgiveness if the funds were used for eligible payroll costs, payments on business mortgage interest payments, rent, or utilities during either the 8- or 24-week period after disbursement.

When do I need to apply for forgiveness by?

A borrower can apply for forgiveness once all loan proceeds for which the borrower is requesting forgiveness have been used. Borrowers can apply for forgiveness any time up to the maturity date of the loan. If borrowers do not apply for forgiveness within 10 months after the last day of the covered period, then PPP loan payments are no longer deferred, and borrowers will begin making loan payments to their PPP lender.

What information and documentation will I need to submit for my PPP loan forgiveness application?

When you’re completing the forgiveness application through the SBA Direct PPP Portal you will need your EIN, SSN, or ITIN, and the SBA loan amount to find your loan. Having this information will auto-populate your loan information into the SBA Form 3508S. SBA form 3508S does not require borrowers to provide additional documentation to show the calculations used to determine their loan forgiveness amount. However, SBA may request information and documents to review those calculations as part of the loan review or audit processes. Those requested documents may include your business’ tax documents, Copies of canceled checks, Bank statements with ACH information, Utility bills, Mortgage statements, Lease agreements, List of all employees on your payroll during the covered period, Evidence that your employees were kept on payroll or rehired upon receiving the loan, Calculation of the average monthly number of full-time equivalent employees for the covered period.

If I already started making payments or paid off my PPP loan, but never applied for forgiveness am I still eligible to apply?

If you have started making payments towards your PPP loan, but have an outstanding balance, you are still eligible to apply for PPP loan forgiveness. Additionally, any payments made towards your PPP loan balance prior to the date you submit your loan forgiveness application may be returned to you, if loan forgiveness is approved, up to the approved loan forgiveness amount.

How do I check the status of my forgiveness application?

You can login through the SBA Direct PPP Portal or email an inquiry including your name and loan number to [email protected], or you can call the SBA office at 877-552-2692 from Monday through Friday, 8:00 a.m. to 5:00 p.m. ET.

If forgiven, who determines the amount of loan forgiveness?

All forgiveness decisions are determined by the SBA and lenders must abide by those decisions. Forgiveness requests may not be granted in full.

If my request for PPP loan forgiveness is denied or only partially approved, can I request a review of that decision?

You have the right to appeal certain SBA loan review decisions. You have 30 calendar days after receipt of the final SBA loan review decision to file a PPP appeal. Appeals must be filed at appeals.sba.gov. If you do not file an appeal with the SBA, your loan will go into repayment.

If denied for forgiveness, when and how do I start making payments on my PPP loan?

You have the right to appeal certain SBA loan review decisions. For borrowers that appeal the SBA’s forgiveness decision, the deferment period is extended until after the SBA renders a decision on a borrower’s appeal. Repayment options are lender specific. Once Lendistry receives the SBA’s final forgiveness decision, Lendistry will notify you of your repayment options. If an appeal is submitted to the SBA you will need to send Lendistry a copy of the appeal, as your payments will be deferred until a final decision is given.
