Consent for Electronic Signatures and Documents

By marking “I agree to Lendistry’s Consent for Electronic Signatures and Documents” on Lendistry’s online portal, Applicant expressly consents to receiving disclosures and documents online and electronically pursuant to this Consent for Electronic Signatures and Documents (the “E-Consent”). Applicant’s consent applies to all agreements, certifications, documents, and disclosures provided electronically in connection with its Application (collectively the “Documents”). Documents may be provided to Applicant either on the screen, on Recipients’ website, or via electronic mail to the email address provided. Such consent also applies to the receipt of SMS/Text messages for online security purposes, such as security codes for the completion of two-factor authentication. 

System Requirements. The following are the minimum hardware and software required to enable Applicant to do business with Lendistry:

Access and use Lendistry’s online
portal: 
Access to a PC or MAC compatible computer or other device capable of accessing the Internet and an Internet Browser software program that supports at least 128-bit encryption, such as Microsoft® Internet Explorer, Netscape®, Safari®, Mozilla Firefox®, or Google Chrome® or similar software. 
Complete the security verification step required to access Lendistry’s online portal:  Access to a mobile device that accepts SMS/Text messages. 
Complete the identity verification section of
the Application: 
Access to an electronic device capable of accessing the Internet and an Internet Browser software program capable of taking photos in real time.  
Open and read most Documents:  A PDF file reader like Adobe® Acrobat Reader Xpdf® or Foxit® or similar software. 
Complete required
forms by hand: 
Access to a printer and a scanner (or other device capable of capturing and converting completed documents to a PDF). 

 

If these requirements change while you are maintaining an active relationship with Lendistry, and the change creates a material risk that you may not be able to receive Documents electronically, Lendistry will notify you of these changes. 

Withdrawal of E-Consent. You are free to withdraw this E-Consent at any time and at no charge. However, if you withdraw this E-Consent before receiving financing services, such withdrawal may prevent you/Applicant from obtaining financing services from Lendistry. If at any time you wish to withdraw this E-Consent, please send us your written request by email to [email protected] or by mail to B.S.D. Capital, Inc., 777 S. Alameda St., 2nd Floor, Los Angeles, CA 90021 with the details of such request. If you decide to withdraw this E-Consent, the legal effectiveness, validity, and enforceability of prior electronic Documents will not be affected. 

Updating Your Contact Information. You should keep us informed of any change in your electronic address or mailing address. You may update such information through your online profile settings. You may also send us your written update by mail to our address above, or by calling us at any toll-free number we provide to you directly or on lendistry.com. 

Paper Records (Credit Applicants Only). If at any time you wish to receive paper copies of your records with Lendistry, please send us your written request by email to [email protected] or by mail to B.S.D. Capital, Inc., 777 S. Alameda St., 2nd Floor, Los Angeles, CA 90021 with the details of such request.
